Design patents are meant to protect the features of shape, configuration, pattern or ornamentation which give a product a unique appearance, and must be new and distinctive. 

As far as design patent applications are concerned, the drawings themselves are the claims. It is the drawing’s job to visually and precisely define the extent of the novel design.

Design registration is intended to protect designs which have an industrial or commercial use. A registered design gives you, the owner, exclusive rights to commercially use it, licence or sell it and makes taking legal action against infringement and copying more straightforward. The registration protects any aspect of your design, for example, both the products shape and decoration.

To register a design, it should be non-offensive and must not make use of protected emblems or flags. It cannot be an invention or illustrate how a product works as you cannot protect the functionality of a design - you will require a utility patent instead.

The required formats for design drawings also differ from country to country. Certain jurisdictions will require contour shading to be present on all illustrations, whereas, other country requirements will insist on the contour shading to be removed. We utilise this knowledge and implement this within the drawings to avoid any possible objections that may arise.
